Agreement to Terms

These Terms of Service ("Terms") govern your use of the Tagqir website (tagqir.com) and the photography and videography services we provide. By accessing our website or engaging our services, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you may not access our website or use our services. These Terms apply to all visitors, users, and clients of our services.

Services Description

Tagqir provides professional event photography and videography services including but not limited to:

• Wedding photography and videography
• Corporate event documentation
• Special occasion photography (birthdays, anniversaries, graduations, etc.)
• Drone aerial photography and videography
• Photo and video editing services
• Digital file delivery through online galleries

Specific services, deliverables, and timelines are detailed in individual service agreements signed at the time of booking.

Booking and Contracts

Booking Process

To book our services, clients must:

• Complete a consultation meeting to discuss event requirements
• Review and sign a service agreement outlining specific deliverables
• Pay the required deposit to secure the booking date
• Provide necessary event details (date, time, location, schedule)

Service Agreements

All bookings are subject to a written service agreement that specifies:

• Event date, time, and location
• Coverage duration and number of photographers/videographers
• Specific deliverables (number of edited images, video length, etc.)
• Payment schedule and total fees
• Delivery timeline for final files
• Cancellation and rescheduling policies

The signed service agreement takes precedence over these general Terms for specific booking details.

Payment Terms

Deposits and Payment Schedule

A non-refundable deposit is required to secure your booking date. The deposit amount and payment schedule are specified in your service agreement. Typical payment terms include:

• Deposit due at contract signing to secure the date
• Remaining balance due before or on the event date
• Payment accepted via bank transfer, cash, or other methods as agreed

Late Payments

Failure to make payments according to the agreed schedule may result in:

• Delay in final file delivery
• Cancellation of services if payment is not received by the event date
• Additional administrative fees for significantly overdue payments

Pricing and Additional Fees

Package prices include the services and deliverables specified in your agreement. Additional fees may apply for:

• Services requested beyond the contracted coverage time
• Rush editing or expedited delivery requests
• Additional edited images beyond the package quantity
• Travel to locations outside our standard service area
• Printing services or physical albums (if requested)

Cancellation and Rescheduling

Client-Initiated Cancellation

If you need to cancel your booking:

• The deposit is non-refundable regardless of cancellation timing
• Cancellations more than 90 days before the event: deposit retained, no additional charges
• Cancellations 30-90 days before the event: 50% of total package price due
• Cancellations less than 30 days before the event: full package price due

Rescheduling

Event rescheduling is subject to our availability on the new date:

• First rescheduling at no additional charge if new date is available
• Subsequent rescheduling may incur administrative fees
• If the new date is unavailable, standard cancellation terms apply

Tagqir-Initiated Cancellation

In the unlikely event we must cancel your booking due to circumstances beyond our control (illness, emergency, equipment failure despite backups), we will:

• Attempt to provide a qualified substitute photographer at no additional cost
• If substitution is not acceptable, provide a full refund of all payments made
• Our liability is limited to the amount paid; we are not responsible for other expenses related to your event

Copyright and Image Rights

Copyright Ownership

Tagqir retains full copyright to all photographs and videos created during your event. This means:

• We own all rights to the images and videos
• We control reproduction, distribution, and commercial use of the work
• Copyright cannot be transferred or sold

Client License

Upon full payment, you receive a limited license to use the images for:

• Personal use and enjoyment
• Sharing with family and friends (digital and prints)
• Posting on personal social media accounts
• Creating personal albums and displays

Restrictions

You may not:

• Use images for commercial purposes without written permission
• Sell, license, or redistribute images to third parties
• Remove watermarks or alter copyright information
• Claim copyright or ownership of the images
• Significantly alter images in a way that misrepresents our work

Tagqir's Use of Images

We reserve the right to use images from your event for:

• Portfolio and website display
• Social media marketing and promotion
• Advertising and printed marketing materials
• Photography competitions and publications

You may opt out of promotional use by providing written notice. This does not affect our copyright ownership.

Deliverables and Timelines

Image Selection and Editing

We select images for editing based on technical quality, artistic merit, and storytelling value. The editing process includes:

• Culling to remove duplicates, test shots, and technically flawed images
• Color correction and exposure adjustment
• Retouching as appropriate for the image
• Consistent editing style throughout the collection

Raw, unedited files are not included in standard packages and are not available for delivery.

Delivery Timeline

Edited images and videos are delivered according to the timeline specified in your service agreement:

• Essential Coverage: 2 weeks
• Complete Coverage: 3 weeks
• Premium Coverage: 4 weeks

Timelines begin from the event date. Delays may occur during peak season or due to circumstances beyond our control. We will communicate any expected delays promptly.

File Delivery

Final images are delivered through a secure online gallery where you can:

• View all edited images
• Download high-resolution files
• Share gallery access with family and friends

Galleries remain active for 90 days after delivery. You are responsible for downloading and backing up your files during this period.

Client Responsibilities

To ensure smooth service delivery, clients agree to:

• Provide accurate event information (date, time, location, schedule)
• Communicate any special requirements or important moments to capture
• Coordinate with venue staff regarding photography permissions and restrictions
• Provide a detailed timeline and contact information for key individuals
• Ensure adequate time in the schedule for planned photography sessions
• Inform us of any hazardous conditions at the venue
• Treat our team and equipment with respect
• Make final payment according to the agreed schedule

Limitation of Liability

Equipment and Technical Issues

While we maintain professional equipment and backup systems, technical failures can occur. In the event of equipment malfunction:

• We will use backup equipment to continue coverage
• Our liability is limited to a refund of fees paid
• We are not responsible for missed moments due to equipment failure despite reasonable precautions

Venue Restrictions

Some venues impose restrictions on photography (flash limitations, photographer positioning, etc.). We will work within these restrictions, but cannot guarantee specific shots if prevented by venue rules.

Weather and External Factors

We are not responsible for weather conditions, lighting limitations, or other factors beyond our control that may affect image quality or availability of planned shots. We will make reasonable efforts to adapt to conditions and suggest alternatives.

Third-Party Actions

We are not liable for actions of guests or other vendors that interfere with photography coverage, including guests blocking shots or other vendors' equipment obstructing our work.

Maximum Liability

In all cases, our total liability is limited to the amount paid for services. We are not responsible for consequential damages, lost opportunities, or expenses beyond our service fees.

Force Majeure

Neither party is liable for failure to perform obligations due to circumstances beyond reasonable control, including:

• Natural disasters (typhoons, earthquakes, floods)
• Government actions or restrictions
• Public health emergencies
• Transportation failures
• Other unforeseeable circumstances

In such events, we will work with you to reschedule or provide alternative arrangements when possible.

Dispute Resolution

Any disputes arising from these Terms or our services will be resolved through:

• Initial good-faith negotiation between parties
• Mediation if negotiation is unsuccessful
• Arbitration or legal proceedings in Cagayan de Oro City, Philippines if other methods fail

These Terms are governed by the laws of the Republic of the Philippines.

Privacy and Data Protection

Our collection and use of personal information is governed by our Privacy Policy. By using our services, you also agree to our Privacy Policy terms. Please review the Privacy Policy for details on how we handle your personal data in compliance with the Philippine Data Privacy Act.

Website Use

Acceptable Use

When using our website, you agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code or attempt to harm the website
• Collect information about other users
• Impersonate others or provide false information

Content Accuracy

We strive to provide accurate information on our website, but:

• Information is provided "as is" without warranties
• Pricing and service details may change without notice
• Portfolio images are examples and do not guarantee identical results for your event

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our website or services after changes indicates acceptance of the modified Terms.

For existing bookings, the Terms in effect at the time of contract signing will apply unless both parties agree to updated terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with your signed service agreement and our Privacy Policy, constitute the entire agreement between you and Tagqir regarding our services and supersede all prior agreements and understandings.
